1. Introduction

These End-User Terms of Use (“Terms”) govern the access to, and use of the TAPA Intelligence System (“TIS”) provided by TAPA EMEA (“TAPA”, “we”, “our”, or “us”).

By registering for, accessing, or using the TIS platform, you (“User”, “you”, or “your”) agree to comply with these Terms. If you do not agree with these Terms, you must not access or use the platform.

2. Eligibility

Access to TIS is restricted to:

Current TAPA EMEA Members in good standing;
Authorized representatives of member organizations;
Users specifically approved by TAPA EMEA;
Other parties granted access by written authorization from TAPA EMEA.

Users must ensure that all registration information remains accurate and up to date.

3. User Accounts

Users are responsible for:

Maintaining the confidentiality of their login credentials;
Ensuring their account is used only by themselves;
Promptly notifying TAPA EMEA of any unauthorized access or suspected security breach;
Ensuring all information provided during registration is accurate.

Account sharing is strictly prohibited.

TAPA EMEA reserves the right to suspend or terminate accounts where misuse is suspected.

4. Acceptable Use

Users agree to use TIS only for legitimate business purposes related to cargo security, supply chain security, and risk management.

Users shall not:

Use the platform for unlawful activities;
Attempt to gain unauthorized access to any system or account;
Circumvent security measures;
Upload malicious software, viruses, or harmful code;
Copy, scrape, extract, or systematically download data without authorization;
Use automated tools to collect platform information unless expressly approved by TAPA EMEA;
Interfere with the operation of the platform.

5. Information Submitted by Users

Users are responsible for ensuring that all information submitted is:

Accurate;
Lawfully obtained;
Not misleading;
Appropriate for the intended purpose.

Users must not knowingly submit false, defamatory, or misleading information.

6. Confidentiality

The information available within TIS may contain confidential and sensitive security-related information.

Users agree to:

Treat all non-public information as confidential;
Use the information solely for legitimate business purposes;
Not disclose confidential information to unauthorized persons;
Maintain appropriate internal security controls.

Confidential information remains the property of TAPA EMEA or the respective data owner.

7. Data Protection

TAPA EMEA processes personal data in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR), where applicable.

Users agree to:

Handle personal information responsibly;
Comply with applicable privacy laws;
Use personal information only for authorized purposes.

8. Intellectual Property

All software, databases, trademarks, logos, documentation, graphics, reports, and other materials available through TIS remain the intellectual property of TAPA EMEA or its licensors.

Nothing within these Terms grants ownership rights to Users.

Users may not:

Copy;
Modify;
Redistribute;
Commercially exploit;
Reverse engineer;
Reproduce;

any part of the platform without prior written permission.

9. Platform Availability

TAPA EMEA will make reasonable efforts to maintain platform availability but does not guarantee uninterrupted service.

The platform may occasionally be unavailable due to:

Maintenance;
Upgrades;
Security updates;
Technical failures;
Events beyond TAPA EMEA’s reasonable control.

10. Security

Users agree to:

Use strong passwords;
Protect login credentials;
Report suspected compromises immediately;
Follow all published security guidance.

TAPA EMEA may suspend access where security risks are identified.

11. Monitoring

TAPA EMEA reserves the right to:

Monitor platform usage;
Record system activity;
Investigate suspected misuse;
Audit compliance with these Terms.

Monitoring is conducted for security, operational, and compliance purposes.

12. Suspension and Termination

TAPA EMEA may suspend or terminate access immediately where:

These Terms are breached;
Membership expires or is terminated;
Payment obligations are not met;
Security concerns arise;
Fraudulent or unlawful activity is suspected.

Termination of access does not remove obligations relating to confidentiality or intellectual property.

13. Disclaimer

The information contained within TIS is provided on an “as is” and “as available” basis.

Although TAPA EMEA makes reasonable efforts to maintain accurate information, no guarantee is provided regarding:

Accuracy;
Completeness;
Timeliness;
Reliability;
Fitness for a particular purpose.

Users remain responsible for their own operational decisions.

14. Limitation of Liability

To the fullest extent permitted by applicable law, TAPA EMEA shall not be liable for:

Indirect losses;
Consequential damages;
Loss of business;
Loss of profits;
Loss of data;
Business interruption;

arising from the use of, or inability to use, the TIS platform.

15. Third-Party Services

The platform may contain links to or integrate with third-party services.

TAPA EMEA is not responsible for the content, availability, or practices of third-party providers.

16. Changes to the Platform

TAPA EMEA may modify, enhance, restrict, or discontinue features of the TIS platform at any time without prior notice.

17. Changes to these Terms

TAPA EMEA reserves the right to amend these Terms from time to time.

Continued use of the platform after revised Terms become effective constitutes acceptance of those changes.

18. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable to TAPA EMEA.

Any disputes shall be subject to the exclusive jurisdiction of the competent courts determined by TAPA EMEA’s registered legal entity.

20. User Acceptance

By registering for, accessing, or using the TAPA Intelligence System (TIS), the User acknowledges that they have read, understood, and agree to be bound by these End-User Terms of Use.

If the User does not agree with these Terms, they must not access or use the TIS platform.

21. Cargo Incident Reporting

The TIS platform enables Users to submit cargo crime and security incident information for the benefit of the TAPA EMEA community.

By submitting an incident, the User represents and warrants that:

The information submitted is accurate and based on the best available knowledge.
The User has the authority to submit such information.
The submission does not knowingly contain false, misleading, defamatory, or unlawful content.
Any personal information included has been collected and shared in accordance with applicable data protection laws.
TAPA EMEA may review, validate, edit, anonymize, classify, or decline publication of any submitted incident.

TAPA EMEA reserves the right to remove or modify any incident report that is inaccurate, inappropriate, or inconsistent with the objectives of the platform.

22. Document Uploads

The TIS platform may permit Users to upload documents, images, reports, or other electronic files.

Users agree that they shall not upload:

Malicious software, viruses, ransomware, or other harmful code;
Copyrighted material without the necessary rights or permissions;
Confidential information belonging to third parties without authorization;
Material that is unlawful, defamatory, offensive, discriminatory, or otherwise inappropriate.

By uploading documents, the User grants TAPA EMEA a non-exclusive, worldwide, royalty-free license to store, process, display, and use the uploaded content solely for the operation, administration, security, and improvement of the TIS platform.

TAPA EMEA reserves the right to remove uploaded content that violates these Terms or applicable law.

23. Route Planning and Mapping Services

TIS may provide mapping, routing, and location-based services, including the display of cargo crime incidents, certified facilities, and security-related information.

Users acknowledge that:

Route planning results are provided for informational purposes only.
TAPA EMEA does not guarantee that suggested routes are the safest, shortest, or most appropriate.
Users remain solely responsible for operational decisions and risk assessments.
Historical incident information does not guarantee future security conditions.

TAPA EMEA shall not be liable for any loss or damage resulting from reliance on route planning or mapping information.

24. API Access and System Integration

Where API access is provided, it is subject to separate approval by TAPA EMEA and may require the execution of an API or Partnership Agreement.

Users granted API access agree that they shall:

Use the API only for the approved business purposes;
Protect API credentials from unauthorized access;
Not share API keys or authentication credentials with third parties;
Not attempt to circumvent rate limits, security controls, or access restrictions;
Not reverse engineer, decompile, or attempt to extract the underlying software or source code;
Immediately notify TAPA EMEA of any suspected compromise of API credentials.

TAPA EMEA reserves the right to suspend, restrict, rotate, or revoke API credentials at any time where misuse, excessive usage, security risks, or non-compliance with these Terms is identified.

25. Data Sharing and Information Use

The TIS platform facilitates the sharing of cargo security intelligence among authorized Users.

Users acknowledge and agree that:

Information accessed through TIS is provided solely for internal business, security, and risk management purposes.
Users shall not redistribute, publish, sell, license, or otherwise disclose TIS data to unauthorized third parties without prior written consent from TAPA EMEA.
Bulk downloading, automated extraction, scraping, or reproduction of TIS data is prohibited unless expressly authorized in writing.
Where data is exported using approved platform functionality, Users remain responsible for protecting the confidentiality and security of that data.
Users shall implement appropriate technical and organizational measures to safeguard exported information against unauthorized access or disclosure.

26. Data Ownership and Licensing

Unless otherwise stated, all cargo incident records, analytical outputs, risk assessments, reports, maps, dashboards, software, databases, and other platform content remain the property of TAPA EMEA or the respective data owner.

Submission of data to TIS does not transfer ownership of the original information. However, by submitting information, the User grants TAPA EMEA a perpetual, worldwide, non-exclusive, royalty-free license to:

Store and manage the data;
Analyze and classify the information;
Produce anonymized statistics and intelligence reports;
Share aggregated or anonymized information with authorized Users;
Improve TIS products and services.

Personally identifiable information will be processed in accordance with applicable privacy legislation.

27. Audit Logs and System Security

To maintain the integrity and security of the platform, TAPA EMEA may record and retain system logs, including:

User login activity;
IP addresses;
API requests;
Data uploads and downloads;
Incident submissions;
Search activity;
Administrative actions.

These records may be used for:

Cybersecurity monitoring;
Incident investigation;
Regulatory compliance;
Platform administration;
Detection and prevention of fraud or misuse.

28. Enforcement

Failure to comply with these Terms may result in one or more of the following actions:

Temporary suspension of access;
Permanent termination of user accounts;
Revocation of API access;
Restriction of data export privileges;
Notification to the User’s employing organization.
Suspension or termination of TAPA EMEA membership where applicable.
Legal actions were permitted by law.

TAPA EMEA reserves all rights and remedies available under applicable law.

Copyright and Ownership

These TIS End User Terms of Use (“Terms”) and the TAPA EMEA Intelligence System (“TIS”) platform including all associated software, databases, methodologies, workflows, documentation, reports, algorithms, dashboards, interfaces, and related know-how — are © TAPA EMEA 2026 – All Rights Reserved. TAPA EMEA owns all copyright and other intellectual property rights in TIS and these Terms. Other than the right to access and use TIS under a valid TAPA EMEA membership or partnership agreement, nothing in these Terms grants any End User any ownership, license, trademark, patent, database right, or other IP interest in TIS or its content.

Permitted Use

Access to TIS is provided solely for cargo-crime intelligence, trend analysis, route risk assessment, and security awareness. Without TAPA EMEA’s prior written permission, and except as permitted by law, End Users must not:

copy, reproduce, extract, scrape, or bulk-download TIS content for use outside the platform
republish, redistribute, sublicense, or create derivative works from TIS content
share login credentials or permit third-party access via their account
attempt to identify reporting organisations or individuals from TIS information
use TIS content for any purpose other than those stated above, including competitive intelligence or resale.

Unauthorized use, or any attempt at re-identification, may result in suspension of access and/or legal action.

1. Liability

TAPA EMEA is not responsible for any consequences of failure to access TIS, misuse of TIS data, or non-compliance with these Terms. Content is subject to change and possible errors at any time and is provided “as is” without warranty of completeness or accuracy.
